Fairfield Marriage License Process

The City of Fairfield directs residents to the Butler County Probate Court for marriage licenses. The Probate Division of the Butler County Court of Common Pleas has jurisdiction over marriage licenses, name changes, birth record corrections, trusts, wills, adoptions, and legal guardianship. Both people must go to the court in person. Bring valid photo ID and your Social Security numbers. If either person was married before, a certified copy of the divorce decree or death certificate is required. Ohio law under ORC Chapter 3101 sets the rules. Both applicants must be at least 18 to marry without parental consent. The license fee in Butler County runs between $50 and $100, and the license is good for 60 days.

Fairfield has its own Municipal Court that handles misdemeanor criminal cases, traffic violations, and civil cases up to $15,000. But that court does not deal with marriage licenses at all. Marriage licensing is strictly a Probate Court function in Ohio.
