Historical Marriage Records in Toledo

Lucas County marriage records go back to 1835. The Ohio History Connection holds microfilm copies of marriage records from many Ohio counties at the Ohio History Center in Columbus. There is no statewide index for marriages, so you need to know the county where the marriage took place.

The FamilySearch Ohio Vital Records page has free digitized marriage records for Lucas County as part of the Ohio County Marriages collection covering 1789 to 2016. You will need a free account to view images. The Ancestry Ohio Marriage Index covers 1970 to 2007 with more than 3 million records. It is a paid service but free at many public libraries.

Toledo Marriage License Requirements

To get a marriage license in Toledo, both people must appear at the Lucas County Probate Court with valid photo identification. A driver's license, state ID, or passport will work. If either person was married before, they must bring a certified copy of the final divorce decree or the death certificate of the former spouse. The court will not issue a license without this paperwork.

Under Ohio law, both people must be at least 18 years old. If one person is 17, parental consent is required along with approval from the juvenile court. Neither person can be currently married. The applicants cannot be nearer of kin than second cousins. These rules come from ORC Section 3101.01. The court checks these details during the application.

Once you have the license, any authorized person can perform the ceremony. This includes ordained ministers, judges, mayors, and certain other officials. The person who performs the ceremony must file the marriage return with the probate court within 30 days. If the return is not filed, the marriage is still valid, but the record may not show up in searches right away.
